Maker Agreement
Version 2026-10-10, effective October 10, 2026
Draft; counsel review pending
Makers agree to this Maker Agreement together with the Terms of Service. Fees at a glance are on Sell With Us; work placed with a partner gallery is also covered by that gallery's consignment terms (see the default consignment template).
Draft prepared by Salish Sea Crafts; counsel review pending. This version takes effect on October 10, 2026. It is not legal advice to you; when a reviewed version is published it will carry a new version date and you will be asked to accept it again.
This Maker Agreement is between Salish Sea Crafts ("SSC"), operated by Fizzgig, LLC, and you, the maker accepting it (the "Maker"). It applies together with the Terms of Service, which you also accept.
1. Acceptance and electronic records
- You accept this agreement electronically. SSC records the version, a hash of the text you saw, the time, your IP address and browser.
- You agree to receive this agreement, payout and tax statements, order notices and changes to this agreement electronically, by email and in your dashboard.
- When SSC publishes a new version, your dashboard asks you to accept it before you continue to sell. Orders already placed stay under the version in effect when they were placed.
2. SSC's role
- SSC is the merchant of record for every sale of your work, online, on a partner website, or at a partner gallery's counter. You make the work and fulfil the order (or a gallery fulfils it, for work consigned there) on SSC's behalf.
- SSC acts as your limited payment agent: it collects the buyer's payment and pays your share, and, for consigned work, the gallery's share. SSC is not a party to any consignment agreement between you and a gallery.
3. Fees and payouts
- Platform fee. SSC keeps 10% of every dollar it processes for your sales except sales tax and the buyer's shipping charge. The fee applies to the item price and to gift wrap and handling fees.
- Gallery fee. On a sale fulfilled from stock you consigned to a gallery, the gallery's fee (the percentage you accepted in that gallery's consignment agreement) is also deducted, calculated on the pre-tax price. No gallery fee applies to sales you fulfil yourself.
- Gift wrap and handling. The net gift-wrap charge goes to whoever wraps and fulfils the line. A disclosed handling fee goes to the shipper. Galleries take no percentage of gift wrap or handling.
- Postage. When live rates are on, SSC buys and owns your shipping labels: the buyer's shipping charge stays with SSC, you pay for no labels, and you receive no postage money. When live rates are unavailable and checkout used an estimated shipping charge, you buy the postage for that shipment yourself (section 5); the buyer's shipping charge still stays with SSC and you receive no postage money for it. SSC may change how such postage is handled, for example by reimbursing it, only by publishing a new version of this agreement.
- Payout timing. Your share is transferred to your Stripe Express account when the order is paid. Stripe then pays it to your bank on your Stripe payout schedule.
- Refunds reverse your share in proportion to the refunded lines, except that a package lost or damaged in transit is refunded by SSC without reversing your share when you shipped it as this agreement requires (section 5).
- You must complete Stripe onboarding before your work can be sold, including at a gallery. A monthly statement of your gross sales, fees and transfers is sent by the 15th of the following month.
4. Listings and fulfilment
- List only work you make yourself in the San Juan Islands or the wider Salish Sea region. Describe materials, size and condition accurately, and keep stock and lead times current.
- Pickup from you. If you offer local pickup, hand the order over as your listing describes. Buyers have 48 hours from handoff to report a problem.
- Gift wrap. If you offer gift wrap, you wrap the item, it ships wrapped inside the shipping box, and the gift message is printed on the packing slip. Gift wrap is not refundable once performed.
- Classes. If you host classes, you set each session's capacity and a written cancellation policy that buyers see before booking. Attendee names and emails are shared with you only to run the class. Class refunds are issued by SSC; if you cancel a session, SSC refunds its attendees.
5. Shipping Addendum
- Parcel accuracy. Keep each product's weight, packaged size and box profile accurate. Rates are quoted from that data.
- Quote-versus-label difference. SSC absorbs up to $2 when a label costs more than the quote. When the excess is caused by parcel data you entered or changed, it is recorded against you on the shipment ledger. SSC may invoice that amount or deduct it from future payouts; it is not taken automatically from a transfer.
- Handling fee. You may charge a handling fee of up to $3 per shipment group. It is shown to buyers at checkout and paid to you.
- Labels and addresses. When live rates are on, SSC buys the label and is the shipper of record. You consent to your ship-from address printing on labels as the return address, and you keep it current and verified.
- Estimated-rate shipments. When live rates are unavailable, the order carries an estimated shipping charge and the shipment is yours to post: you buy the postage with your own account, ship on time, and enter the carrier and tracking number in your dashboard. The postage is yours (section 3), and SSC adds no insurance or signature requirement to these shipments.
- Ship on time. Ship within 3 business days of the order unless your listing states a longer lead time. SSC reminds you about orders whose label has not been bought.
- Insurance and claims. On labels SSC buys, parcels with a declared value above $100 are insured, and those above $250 require a signature, at SSC's cost. If a parcel is lost or damaged in transit, SSC refunds the buyer and files the carrier claim; you cooperate by keeping and providing photos of the item and packaging.
- Oversize items are offered for pickup or by a quote arranged through messaging.
6. Gallery consignment (optional)
- Consigning to a partner gallery is optional. It starts only when you accept a gallery's invitation and the consignment agreement that gallery has published, and you must be Stripe-onboarded to accept.
- Your consignment agreement is between you and the gallery. When the gallery publishes a new version, work already there keeps selling under the version you accepted, but new intake waits until you accept the current version.
- One price everywhere. Your live listed price governs online and in the gallery. A minimum price you set per item is enforced at the counter, and galleries may not discount your work.
- Each item carries an agreed value (what you are owed if it is lost or damaged at the gallery) and, where required, a minimum price.
- The gallery records each intake and return. You have 7 days from an intake or return record to dispute it; after that it is final.
- You cannot delete or unpublish a product while a gallery still holds units of it.
- Loss of or damage to your work while in a gallery's custody is settled between you and the gallery under your consignment agreement, outside SSC.
- Display and social-media use of consigned work follows the consents in your consignment agreement.
7. Taxes
- SSC collects and remits Washington sales tax on your sales as a marketplace facilitator (RCW 82.08.0531). Do not add sales tax to your prices.
- Your monthly statement reports the gross sales SSC made on your behalf. You remain responsible for your income tax and B&O tax.
- Stripe issues Form 1099-K when your payments meet the IRS reporting threshold in force for the tax year. Keep your tax details in Stripe accurate; questions about whether you receive a form go to Stripe.
8. Data and support access
- Buyer names, addresses and contact details are shared with you only to fulfil orders and run classes. Do not use them for anything else, including marketing, without the buyer's separate consent.
- To support you, an SSC administrator may view your account as you see it. Every such session is logged.
9. Term, changes and governing law
- You may stop selling at any time. SSC may suspend or end your account for breach of this agreement or the Terms, for fraud, or to protect buyers, after notice where practical. Open orders must still be fulfilled or refunded, and consigned stock is returned under your consignment agreements.
- This agreement is governed by Washington law. Disputes go to the state or federal courts for San Juan County, Washington, after an attempt to resolve them informally.
